Commission Terms & Conditions
These terms establish the working agreement between the client and Clausell Sylvester Art regarding commissioned artwork. By submitting a commission deposit, the client acknowledges and agrees to the following policies, procedures, and conditions.
SECTION 1 — COMMISSION OVERVIEW
Commission Services
Clausell Sylvester Art offers commissioned original artwork based on agreed concepts, themes, references, and creative direction discussed between the artist and the client.
Commission categories may include:
- Portrait commissions
- Music-inspired artwork
- Cultural legacy artwork
- Spiritual concept pieces
- Panamá-inspired artwork
- Figurative studies
- Collector-exclusive commissions
Each commissioned work is an original artwork created specifically for the client unless otherwise agreed in writing.
SECTION 2 — CONSULTATION PROCESS
Consultation & Approval
All commissions begin with a consultation process to establish:
- Subject matter
- Artistic direction
- Preferred dimensions
- Medium
- Timeline
- Pricing
- Shipping requirements
- Reference materials
- Creative expectations
Clausell Sylvester Art retains full artistic interpretation rights while respecting the agreed conceptual direction.
SECTION 3 — PRICING
Pricing Structure
Commission pricing is determined by:
- Artwork size
- Complexity
- Medium
- Subject matter
- Detail level
- Deadline requirements
- Shipping requirements
- Licensing or reproduction requests
Final pricing is confirmed before work begins.
SECTION 4 — DEPOSIT REQUIREMENT
Deposit Policy
A non-refundable deposit of 50% is required before any commission work begins unless otherwise agreed in writing.
The remaining balance must be paid in full prior to shipping or delivery.
Failure to submit the remaining balance within the agreed timeframe may result in cancellation of the commission and forfeiture of the deposit.
SECTION 5 — PAYMENT TERMS
Accepted Payments
Accepted payment methods may include:
- Credit/Debit Card
- PayPal
- Shopify Payments
- Stripe
- Bank transfer (approved collectors only)
Payment plans may be available for larger commissions at the artist’s discretion.
SECTION 6 — CREATIVE RIGHTS
Artistic Discretion
Clausell Sylvester Art maintains full artistic discretion regarding style, composition, interpretation, color choices, and execution.
The client commissions the artist’s vision and creative process rather than exact duplication of reference images.
SECTION 7 — REVISIONS
Revision Policy
Reasonable revisions may be discussed during approved stages of the commission process.
Major conceptual changes after work has substantially progressed may require additional fees.
Completed artwork is not eligible for complete redesign without a new commission agreement.
SECTION 8 — TIMELINES
Estimated Completion Time
Completion timelines vary depending on:
- Artwork complexity
- Current commission queue
- Size and detail
- Material availability
- Shipping logistics
Estimated timelines are provided in good faith but are not guaranteed delivery deadlines unless explicitly agreed in writing.
SECTION 9 — SHIPPING & DELIVERY
Shipping Policy
Clients are responsible for shipping costs unless otherwise stated.
Artwork is carefully packaged to protect against damage during transit.
Shipping timelines may vary depending on destination, customs processing, weather conditions, and carrier delays.
International collectors are responsible for any applicable customs duties, taxes, or import fees.
SECTION 10 — DAMAGE DURING SHIPPING
Damaged Shipments
If artwork arrives damaged, the client must notify Clausell Sylvester Art within 72 hours of delivery and provide photographs of:
- Packaging
- Shipping labels
- Damaged artwork
Claims submitted beyond this timeframe may not qualify for assistance or insurance claims.
SECTION 11 — COPYRIGHT & REPRODUCTION
Copyright Ownership
All copyrights and reproduction rights remain exclusively with Clausell Sylvester Art unless otherwise transferred in writing.
Clients may not reproduce, resell, license, distribute, or commercially exploit commissioned artwork without written permission.
The artist reserves the right to display commissioned artwork in portfolios, exhibitions, social media, publications, promotional materials, and archival documentation unless a confidentiality agreement is established beforehand.
SECTION 12 — REFUNDS & CANCELLATIONS
Refund Policy
Deposits are non-refundable.
If the artist cancels the commission before substantial work begins, payments made beyond the deposit may be refunded.
Completed or substantially completed commissions are not eligible for refunds.
SECTION 13 — COLLECTOR CONFIDENTIALITY
Privacy & Confidentiality
Collector information, personal references, and commission discussions are treated respectfully and confidentially.
Private commissions may remain unpublished upon written request prior to project initiation.
SECTION 14 — FORCE MAJEURE
Unforeseen Circumstances
Clausell Sylvester Art is not liable for delays caused by events outside reasonable control, including but not limited to:
- Natural disasters
- Illness
- Shipping disruptions
- Supply shortages
- Government restrictions
- Technical failures
SECTION 15 — AGREEMENT
Agreement Acceptance
By submitting payment for a commissioned artwork, the client acknowledges understanding and acceptance of these terms and conditions.
